Roland DGA Corporation (“Roland DGA”) warrants to the original end-user purchaser (“You”) that your Roland IU-1000F printer (“Printer”), under normal use and operation, conforms in all material respects to Roland DG’s published specifications, and is free from defects in materials or workmanship, subject to the conditions of warranty listed below.

Term. The duration of this warranty is one year from date of delivery. Any replacement product or non-consumable parts installed during the warranty period are warrantied for the balance of the original warranty period. Your Printer is eligible for an additional one-year term of warranty coverage upon timely registration within 60 days of date of delivery and your exclusive use of Roland DG inks. Your Printer may be eligible for extended service contracts at the end of the warranty term.

This warranty does not cover Roland DG software, ink, media products, consumables, other non-hardware products, or non-Roland DG branded products or components that may be bundled with the Printer, all of which may have their own applicable warranties. This warranty does not extend to the Printer if the product label, logo, rating label or serial number has been tampered with or removed or if the Printer was sold “AS IS” or in “REFURBISHED” condition.

ROLAND DGA DOES NOT WARRANT THAT THE OPERATION OF ANY PRODUCT WILL BE UNINTERRUPTED OR ERROR FREE. Roland does not warrant or guarantee Your end-application. Roland makes no assurances that your Printer will perform according to or meet Your or any third party’s (media, etc.) standards or specifications, or that your Printer will produce output that will meet Your or any third party’s specifications or standards of quality. Neither Roland DGA nor its affiliates shall be liable for any loss, inconvenience, or damage, including special, incidental or consequential damages, including, lost profits, cost of substitute equipment, lost consumables, loss of data, privacy or confidentiality, downtime, claims of third parties, including customers, or injury to property resulting from the use or inability to use the Printer, whether resulting from breach of warranty, breach of contract, negligence, strict tort or any other legal theory.

Time Limits. No claims shall be asserted against Roland DGA or its affiliates, unless the failure or defect giving rise to the claim is sustained prior to the expiration of the warranty period specified herein.  If you discover within the applicable warranty period a failure of the Printer to conform to specifications or a defect in material or workmanship, You must promptly notify Roland DGA in writing.  In no event shall such notification be received by Roland DGA later than FOURTEEN DAYS from the expiration of the warranty term.  Any suit, action or claim asserted in any legal proceeding related in any way to the Printer or this Limited Warranty must be commenced and filed within THREE MONTHS from the expiration of the warranty term.

SOME LOCALTIES, STATES OR COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED IN THE DISCLAIMER OF WARRANTIES SECTION MAY NOT APPLY TO YOU.

Allocation of Risks. This Limited Warranty allocates the risks of product failure between Roland DGA and You.  This allocation is recognized by both parties and is reflected in the price of the Printer.  You, as the purchaser of the Printer, acknowledge that You have read this Limited Warranty, understand it, and are bound by its terms.

You and Roland DGA consent to the exclusive jurisdiction of such courts.

Arbitration. YOU AND ROLAND DGA AGREE THAT ALL CLAIMS, DISPUTES, OR ACTIONS BETWEEN US ARISING FROM OR RELATING TO THE PRINTER AND/OR THIS LIMITED WARRANTY WILL BE ARBITRATED, before a single arbitrator to be conducted in Orange County, California, in accordance with the commercial Arbitration Rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Exclusions from Arbitration. The arbitration requirements above do not apply to claims of infringement or other misuse of intellectual property rights, including seeking injunctive relief.

Class Action Waiver: TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE, WHETHER IN ARBITRATION, IN COURT, OR OTHERWISE, WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. ROLAND DGA AND YOU AGREE THAT NO PARTY WILL HAVE THE RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED AS A CLASS ACTION, A PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. NO ARBITRATION OR PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ANOTHER ARBITRATION OR PROCEEDING WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO ANY SUCH ARBITRATION OR PROCEEDING.

In order to obtain on-site service, you will be required to provide: access to the product; electricity and internet access; a safe and hygienic working environment; an environment that is free from violence, discrimination and harassment; and have an adult present at all times while a servicing technician is on-site.

Right to Change Service. Roland DGA reserves the right to change the method by which Roland DGA may provide warranty service to You, and your Roland DG Product’s eligibility to receive a particular method of service. Service will be limited to the options available in the territory or country where service is requested. Service options, parts availability and response times may vary according to territory or country. You may be responsible for shipping and handling charges if the Roland DG Product cannot be serviced in the territory or country it is in. If you seek service in a country that is not the country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. For international service, Roland DGA may repair or replace Roland DG Products and parts with comparable Roland DG Products and parts that comply with local standards.
